General Terms and Conditions Arjen's Creative Atelier (EU Sales)

Article 1 – Identity of the Entrepreneur

1.1. The entrepreneur: Arjen's Creative Atelier (Sole proprietorship).

1.5. Application KOR: Arjen's Creative Atelier is exempt from sales tax on the basis of the Small Business Scheme (KOR) Article 25 of the Turnover Tax Act 1968.

Article 2 – Applicability

2.1. These General Terms and Conditions (GTC) apply to all offers, orders and agreements between Arjen's Creative Atelier and the consumer within the European Union (EU).

2.2. The consumer must accept the Terms and Conditions before a distance contract is concluded.

Article 3 – The Offer and the Agreement

3.1. The offer contains a complete and accurate description of the products offered (3D-printed kits, models, etc.). All images are a true representation of the products offered.

3.2. The agreement is concluded when the consumer definitively places the order online and complies with the conditions set out therein.

Article 4 – The Price and Payment

4.1. The prices stated in the offer are in Euro (€) and include all statutory levies, with the explicit understanding that no VAT is charged due to the application of the Small Business Act (KOR).

4.2. Additional costs, such as shipping costs, will be clearly stated before the agreement is concluded.

4.3. The consumer must make payments using the payment methods indicated on the website.

4.4. Payments must be made to the business bank account of Arjen's Creative Atelier, with IBAN NL90 RABO 0167 0372 85, within the period stated on the invoice or no later than 14 days after the invoice date.

Article 5 – Right of withdrawal (cooling-off period within the EU)

5.1. The consumer can cancel an agreement regarding the purchase of a product within a 14-day cooling-off period without giving any reason. This period commences on the day after the consumer, or a third party designated by the consumer in advance, receives the product.

5.2. Exclusion of the Right of Withdrawal: The right of withdrawal is excluded for products manufactured to the consumer's specifications (custom-made, personalized, or 3D printed based on a unique customer request/file). This is clearly stated in the offer.

5.3. Exercise: In order to exercise the right of withdrawal, the consumer sends the entrepreneur an unambiguous statement (for example by e-mail or the Model Withdrawal Form) within the cooling-off period.

5.4. Return Costs: The costs for the direct return of the product after cancellation are borne by the consumer.

Article 6 – Delivery and Execution

6.1. The entrepreneur will exercise the utmost care when receiving and executing orders.

6.2. The place of delivery is the address that the consumer has provided to the entrepreneur.

6.3. The delivery period is 30 days after the order, unless a longer period has been agreed. If delivery is delayed, the consumer will be informed in a timely manner.

Article 7 – Complaints Procedure and Disputes

7.1. Complaints about the performance of the agreement must be submitted fully and clearly described to the entrepreneur within a reasonable time (max. 7 days after discovery) via the email address provided.

7.2. Agreements between the entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law.

7.3. Disputes can be submitted to the competent court in the Netherlands. Disputes can be submitted via the European ODR (Online Dispute Resolution) platform.
